These Terms & Conditions ("Terms") constitute a legal agreement between you ("User," "you," or "your") and MentalSaathi ("Company," "we," "us," or "our"). By accessing, browsing, or using MentalSaathi's website, mobile application, and services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Service.
a) Age Requirement: • You must be at least 13 years old to use MentalSaathi • If you are between 13-18 years old, we recommend (and may require) parental or guardian consent • If you are under 18, ensure your parent/guardian is aware of your use of this service • For users under 13: parental/guardian consent is required; we comply with COPPA b) Account Registration: • You are responsible for maintaining the confidentiality of your password • You agree to provide accurate, complete, and up-to-date information • You are responsible for all activities under your account • You must notify us immediately of unauthorized access to your account • We reserve the right to suspend or terminate accounts with inaccurate information c) One Account Per Person: • You agree to maintain only one user account • Creating multiple accounts or impersonating others is prohibited • We reserve the right to merge or delete duplicate accounts
You agree NOT to: • Share, post, or transmit content that is illegal, defamatory, obscene, or harmful • Engage in harassment, bullying, or hate speech targeting individuals or groups • Post or encourage content related to self-harm, suicide, or violence • Share another person's private information without consent • Impersonate, threaten, or intimidate other users or staff • Spam, flood, or engage in abusive behavior • Attempt to access systems, accounts, or data you do not have permission to access • Use automated tools (bots, scrapers) to collect or extract data • Share content that violates intellectual property rights • Attempt to interfere with or disrupt the Service • Use the Service for commercial purposes or unauthorized gain Violation of these terms may result in: • Removal of content • Suspension or permanent termination of your account • Legal action (if applicable) • Reporting to law enforcement (in cases of illegal activity)
IMPORTANT — MentalSaathi is NOT a substitute for professional mental health care: • MentalSaathi provides peer support, wellness tools, and community resources • We are NOT licensed therapists or mental health professionals • Your use of this Service does not establish a therapist-patient relationship • If you are experiencing a mental health crisis, please contact emergency services or a crisis hotline • Check-in scores and mood tracking are for personal awareness only, not diagnostic • Never ignore professional mental health advice in favor of community posts • In case of crisis, use Crisis Support resources (911 in US, India's AASRA: 9820466726) By using MentalSaathi, you assume all risks related to its use and acknowledge that you are responsible for your own mental health and safety.
a) Community Content: • MentalSaathi does not pre-screen user-generated content before posting • We moderate content post-publication based on community guidelines and legal requirements • We are not responsible for user-generated content, though we will remove violating content upon discovery • You are solely responsible for content you post, comment on, or share b) Limitation of Liability: • MentalSaathi provides the Service "AS IS" without warranties • We disclaim all implied warranties, including fitness for a particular purpose • We are not liable for: - Indirect, incidental, special, or consequential damages - Loss of data, privacy breaches (except gross negligence) - Advice or decisions based on community posts or check-in data - Mental health crises, self-harm, or outcomes c) Accuracy of Information: • We strive to provide accurate information but do not guarantee completeness or accuracy • We are not responsible for errors, omissions, or outdated information • Crisis resources and hotlines are provided in good faith but not verified in real-time
a) Company Content: • All MentalSaathi branding, design, code, and original content are protected intellectual property • You may not reproduce, distribute, or modify Company content without written permission • Unauthorized use may result in legal action b) User Content: • You retain ownership of content you post (journals, comments, community posts) • By posting, you grant MentalSaathi a worldwide, royalty-free license to: - Display, reproduce, and distribute your content within the Service - Create backups and archives - Use anonymized/aggregated data for research (with your explicit opt-in) • You grant other users permission to view content you post in shared spaces (community, etc.) • Private content (journals) is not shared unless you explicitly share it c) Copyright Infringement: • Do not post content you do not own or have permission to share • If you believe your copyright is infringed, contact privacy@mentalsaathi.com • We will investigate and remove infringing content upon verification
• MentalSaathi may contain links to external websites and crisis resources • We are not responsible for third-party content, privacy practices, or availability • Use of third-party services (Google Sign-In, SMS providers) is governed by their terms • We do not endorse third-party services, though we curate crisis resources • Verify the legitimacy of external links before sharing personal information
• Your privacy is governed by our Privacy Policy (linked in footer) • By using MentalSaathi, you consent to data collection and processing as described • You have rights to access, correct, delete, and port your data (see Privacy Policy) • We do not sell your data to marketers • Mental health data is treated as sensitive and encrypted
a) Service Modifications: • We reserve the right to modify, suspend, or discontinue features or the entire Service • Changes will be announced via email and in-app notifications • Continued use after changes constitutes acceptance b) Account Termination: • You may delete your account at any time through account settings • We may terminate your account if you violate these Terms • Upon termination, your data will be handled per our Privacy Policy • Some content (e.g., community posts, if anonymized) may remain after account deletion
a) Indemnification: You agree to defend and indemnify MentalSaathi from any claims arising from: • Your violation of these Terms • Your use of the Service in violation of laws • Your content or statements • Misuse of your account b) Governing Law: • These Terms are governed by the laws of India • Any legal action shall be subject to the jurisdiction of Indian courts • For international users, local laws may also apply c) Dispute Resolution: • We encourage you to contact us first to resolve disputes (privacy@mentalsaathi.com) • If unresolved, disputes may be escalated to arbitration or litigation
• If any provision of these Terms is found invalid, the remaining provisions remain in effect • These Terms, along with our Privacy Policy, constitute the entire agreement • No waiver of any provision is valid unless in writing • Our failure to enforce a right does not constitute waiver of that right
